bound by these Terms and Conditions (“Terms”), our Privacy Policy, and any other policies
published on our Website from time to time.
1.4 If you do not agree to these Terms, you must immediately cease using the Website and
must not purchase any Digital Content or Live Sessions.
1.5 We reserve the right to amend these Terms at any time. Amendments take effect from
the date of publication on our Website. Continued use of the Website following any

these Terms periodically.

2.1.1 be at least 18 years of age;
2.1.2 have the legal capacity to enter into a binding contract under Australian law; and

its discretion, including where it reasonably suspects misuse. Where a purchase is cancelled
by Train4Life, a full refund of the purchase price will be provided.

Digital Content and Live Sessions – Description and Purchase
3.1 Train4Life offers pre-recorded educational videos covering baby and child first aid topics
(the “Digital Content”). All Digital Content is created by Aaron Paul Fulton in his capacity as
a registered paramedic.
3.2 From time to time, Train4Life may also present live online education sessions delivered
via an online video platform (“Live Sessions”). Live Sessions may be offered on specific
dates and times as advertised on the Website and may include a limited opportunity for
questions and answers.
3.3 Digital Content and Live Sessions are available for purchase via a one-time payment as
listed on the Website at the time of purchase. All prices are in Australian dollars (AUD).
3.4 Upon completing payment, you will receive online access to the Digital Content via our
Website. Access details will be provided to the email address you nominated at the time of
purchase.
3.5 For Live Sessions, upon completing payment you will receive joining instructions
(including date, time and access link) to the email address you nominated at the time of
purchase. You are responsible for ensuring that you have a stable internet connection and
compatible device to attend any Live Session.
3.6 Train4Life is not currently registered for GST. Prices are therefore exclusive of GST
unless otherwise stated.
3.7 You are responsible for ensuring that your device meets the minimum technical
requirements necessary to access the Digital Content or Live Sessions. Train4Life does not
warrant compatibility with all devices, browsers, or operating systems.
3.8 Digital Content may be updated, amended, or removed from time to time. Your rights
under the ACL are not affected by any such change.

Account Security
4.1 To access the Digital Content or attend the Live Sessions, you may be required to create
an account on our Website. You are responsible for maintaining the confidentiality of your
account login details and for all activity that occurs under your account.
4.2 You must not share your account login details with any other person. Access to your
account is personal to you and is not transferable.
4.3 You must notify us immediately at ask@train4life.au if you become aware of any
unauthorised use of your account.

accepted on our Website from time to time (which may include credit card, debit card, or
other online payment platforms).
5.2 By providing payment details, you authorise Train4Life (or its payment processor) to
deduct the applicable purchase price from your nominated account.
5.3 Train4Life uses third-party payment processors and does not store your full payment
card details. We are not responsible for any errors or failures caused by third-party payment
processors.
5.4 If a payment is declined or fails, your access to the Digital Content or booking any Live
Sessions will not be granted until full payment is received.

Refunds and Consumer Guarantees
6.1 Your rights under the Australian Consumer Law (Schedule 2 of the Competition and
Consumer Act 2010 (Cth)) (“ACL”) cannot be excluded, restricted, or modified by these
Terms. Nothing in these Terms is intended to do so.
6.2 Under the ACL, you are entitled to a refund, replacement, or other remedy if the Digital
Content or Live Sessions:
6.2.1 are not of acceptable quality;
6.2.2 do not match its description as advertised; or
6.2.3 are not fit for the purpose communicated to us at the time of purchase.
6.3 Because Digital Content is delivered by instant online access, please be aware that:
6.3.1 once you have been granted access to the Digital Content, we are unable to offer a
change-of-mind refund unless required by the ACL; and
6.3.2 you should review the course description carefully before purchasing.
6.4 For any Live Sessions, bookings are generally non‑refundable once confirmed, except
as required by the ACL. If you are unable to attend any Live Sessions that you have booked,
you should contact us as soon as possible at ask@train4life.au. We may, at our discretion

and subject to availability, offer a transfer to an alternative session date or provide access to
equivalent pre‑recorded Digital Content in lieu of a refund.
6.5 To request a remedy under the ACL or to make a refund enquiry, please contact us at
ask@train4life.au . We will respond to your request within a reasonable time, and in any
event within 10 business days, except where circumstances beyond our reasonable control
prevent us from doing so.
6.6 For more information about your rights as a consumer, visit the Australian Competition
and Consumer Commission (ACCC) website at www.accc.gov.au .

Intellectual Property
7.1 All intellectual property in and to the Website, the Digital Content and any Live Sessions,
including but not limited to all videos, audio, text, images, graphics, logos, trade marks, and
all other materials (“IP”), is owned exclusively by Aaron Paul Fulton (or an entity he controls)
(“IP Owner”) and is protected by Australian and international intellectual property laws,
including the Copyright Act 1968 (Cth).
7.2 Upon completing your purchase, the IP Owner grants you a personal, non-exclusive,
non-transferable, non-sublicensable licence to access and use the Digital Content strictly for
your own personal, non-commercial use only (“Licence”) for as long as you maintain access
to the Digital Content in accordance with these Terms.
7.3 The Licence permits you to view the Digital Content an unlimited number of times for
personal reference via our Website.
7.4 The Licence does not permit you to:
7.4.1 copy, reproduce, record (including by screen recording or using any other device),
publish, broadcast, transmit, re‑upload, share, or redistribute the Digital Content or any Live
Sessions (in whole or in part) on any platform, including social media, YouTube, or any other
medium;
7.4.2 use the Digital Content or any Live Sessions for any commercial purpose, including
but not limited to training, teaching, presenting, or instructing others in a professional or
commercial capacity;
7.4.3 sell, rent, lend, or otherwise transfer access to the Digital Content to any third party;
7.4.4 edit, modify, adapt, or create derivative works from the Digital Content;
7.4.5 remove, alter, or obscure any copyright notice, watermark, branding, or proprietary
marking on the Digital Content; or
7.4.6 permit any other person to access or use the Digital Content under your Licence,
including by sharing your account login details.
7.5 The IP Owner’s name, brand name “Train4Life”, logo, and all associated trademarks are

the exclusive property of the IP Owner. You must not use any of these marks without prior
written consent.
7.6 Any unauthorised use of the IP will constitute a breach of these Terms and may
constitute an infringement of intellectual property rights, for which the IP Owner may seek all
available legal remedies, including injunctive relief.

Medical Disclaimer
8.1 The Digital Content and any Live Sessions are provided for general educational and
informational purposes only. They are not intended to constitute medical advice, professional
clinical instruction, or a substitute for advice from a qualified medical professional.
8.2 The Digital Content and Live Sessions cover first aid techniques as general information
only. First aid techniques may vary depending on individual circumstances, and the
appropriateness of any technique depends on the specific situation, the child or adult’s
condition, and other factors that cannot be anticipated by Train4Life.
8.3 In any emergency situation, you must immediately contact your local emergency
services. In Australia, this is Triple Zero (000). The Digital Content and Live Sessions are not
a substitute for contacting emergency services.
8.4 Train4Life’s Digital Content and Live Sessions are non-accredited training. Completion
does not result in a formal qualification, certification, or accreditation in first aid or any other
field.
8.5 While Aaron Paul Fulton is a registered paramedic, his role in creating this Digital
Content and presenting Live Sessions is as an educator providing general information to the
public. The Digital Content and Live Sessions do not establish a professional paramedic-
patient relationship between Train4Life and any User.
8.6 You should seek formal, accredited first aid training from a registered training
organisation (RTO) if you require a formal qualification or certification.
8.7 During Live Sessions, any questions you ask and answers provided are of a general
nature only and are not tailored to specific medical circumstances. You must not delay or
avoid seeking professional medical care based on anything discussed in a Live Sessions.

Limitation of Liability
9.1 To the maximum extent permitted by law (including the ACL), Train4Life’s total liability to
you in connection with the Website, Digital Content, any Live Sessions, or these Terms,
whether in contract, tort (including negligence), equity, statute, or otherwise, is limited to the
amount you paid for the Digital Content or Live Sessions giving rise to the claim.
9.2 To the maximum extent permitted by law, Train4Life excludes liability for:
9.2.1 any indirect, incidental, special, or consequential loss or damage of any kind;
9.2.2 loss of profits, revenue, business opportunity, data, or goodwill;

9.2.3 any loss arising from your failure to use the Digital Content or Live Sessions
appropriately or to seek professional assistance when required;
9.2.4 any loss arising from technical failures, interruptions, or errors in accessing the
Digital Content or Live Sessions;
9.2.5 any loss arising from the transmission of viruses or malicious code via third-party
platforms or links; or
9.2.6 any loss arising from your reliance on the Digital Content or Live Sessions in an
emergency situation.
9.3 Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any
guarantee, warranty, or other term or condition, implied or imposed by the ACL or any other
applicable law which cannot lawfully be excluded or limited.
9.4 If the ACL or any other applicable law implies a guarantee, warranty, or condition into
these Terms, Train4Life’s liability for a failure to comply with that guarantee is limited (at
Train4Life’s option) to:
9.4.1 in the case of goods (including Digital Content as goods): the replacement of the
goods or supply of equivalent goods; or
9.4.2 in the case of services (including Live Sessions) the re-supply of the services.

10.1 You agree to indemnify, defend, and hold harmless Train4Life, Aaron Paul Fulton, and
their respective agents and representatives from and against any claims, losses, damages,

10.1.1 your breach of these Terms;
10.1.2 your misuse or unauthorised use of the Digital Content or any Live Sessions;
10.1.3 your infringement of any third-party intellectual property rights; or
10.1.4 any action you take based on the Digital Content or any Live Sessions, including in
an emergency situation.

Website Use and User Obligations
11.1 You agree to use the Website, the Digital Content and any Live Sessions only for lawful
purposes and in accordance with these Terms.
11.2 You must not:
11.2.1 use the Website in any way that is unlawful, fraudulent, or harmful;
11.2.2 attempt to gain unauthorised access to any part of the Website or its underlying
systems;
11.2.3 use automated tools, scraping software, or bots to access or extract content from
the Website;

party rights;
11.2.5 interfere with or disrupt the Website's operation or any server or network connected
to it; or
11.2.6 record, photograph, or otherwise capture any Live Session, or share any Live
Session access link with another person, without our prior written consent.
11.3 We reserve the right to suspend or terminate your access to the Website without notice
if we reasonably believe you have breached these Terms. Where access is terminated due
to a breach by you, no refund will be payable. Where access is suspended or terminated for
reasons other than your breach, your rights under the ACL are preserved.

Third-Party Links
12.1 The Website may contain links to third-party websites for your convenience. Train4Life
does not endorse, control, or take responsibility for the content, privacy practices, or
availability of any third-party website.
12.2 You access any third-party website at your own risk. Train4Life is not liable for any loss
or damage arising from your use of a third-party website.

Consumer Rights Under the Australian Consumer Law
13 Our Digital Content and Live Sessions comes with guarantees under the ACL that cannot
be excluded. You are entitled to a replacement or refund for a major failure, and
compensation for any other reasonably foreseeable loss or damage. You are also entitled to
have the content replaced if it fails to be of acceptable quality and the failure does not
amount to a major failure.
14 Digital Content and Live Sessions sold by Train4Life must:
14.1 be of acceptable quality;
14.2 match its description as advertised on our Website;
14.3 be fit for the purpose of general first aid education as described; and
14.4 be free from defects (including technical defects that prevent access).
15 If you believe a product or service does not meet the above standards, please contact us
directly at ask@train4life.au in the first instance. You may also contact the ACCC at
www.accc.gov.au or call 1300 302 502.

Governing Law and Jurisdiction
16.1 These Terms are governed by the laws of New South Wales, Australia.
16.2 Any dispute arising out of or in connection with these Terms will be subject to the
exclusive jurisdiction of the courts of New South Wales, Australia, and any applicable federal
courts.

Dispute Resolution
17.1 In the event of a dispute, you agree to contact Train4Life in writing at ask@train4life.au
and provide a reasonable description of the dispute and the remedy sought.
17.2 Train4Life will respond to your dispute notice within 15 business days, except where
circumstances beyond our reasonable control prevent us from doing so, and will attempt in
good faith to resolve the dispute by negotiation.
17.3 If the dispute is not resolved within 30 days of the dispute notice, either party may refer
the dispute to mediation by giving written notice to the other party. The mediation is to be
conducted in New South Wales, Australia, by a mediator agreed between the parties, or
failing agreement within 10 business days, a mediator appointed by the Resolution Institute
(or its successor).
17.4 The parties must participate in the mediation in good faith and share the mediator’s
fees and expenses equally. Each party must bear its own legal and other costs of the
mediation.
17.5 If the dispute is not resolved within 45 days after the appointment of the mediator, or
within any longer period agreed in writing by the parties, either party may take such further
action as it deems appropriate.
17.6 Nothing in this clause prevents either party from seeking urgent injunctive or other
interlocutory relief.

General Provisions
18 These Terms, together with our Privacy Policy, constitute the entire agreement between
you and Train4Life with respect to your use of the Website and purchase of Digital Content
or Live Sessions.
19 If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that
provision will be severed from the remaining Terms, which will continue in full force and
effect.
20 A failure or delay by Train4Life to exercise any right or remedy under these Terms does
not constitute a waiver of that right or remedy.
21 You may not assign or transfer any rights or obligations under these Terms without
Train4Life’s prior written consent.
22 Train4Life is not liable for any failure or delay in performing its obligations caused by
circumstances beyond its reasonable control.
